Terms and Conditions. 

1. Only the individual named on the agreement or invoice with Hart Photography will be the person with whom Hart Photography will accept requests or comments from. Example if Tom Clark is the person that signed the agreement then Tom Clark’s wife or other friend or family can not make a change to Tom Clark’s package.
2. Not A Minor.  By coming into this agreement the client certifies that the client is not a minor at the time that this agreement was entered into. 
3. Non-Refundable Deposit.  There is a $500 nonrefundable deposit to book your Photo Shoot. If your fee is less than $500, the non-refundable deposit will be the full balance of the invoice.  
4. No -show.   If you do not keep your scheduled appointment, you will forfeit your deposit.  Hart Photography will wait 10 minutes after your scheduled time prior to declaring your deposit forfeited.  It is at Hart Photography’s discretion wheather Hart Photography will allow the client to reschedule the no-show session. 
5. Rescheduling a Photo Session. To reschedule an appointment, you must make the request via email to Elite@HartPhotography.Net at least 14 calendar days prior to the scheduled appointment and receive a confirmation of your rescheduling form Hart Photography.   A phone call is not sufficient.  You agree that if you do not reschedule prior to the 14 calendar days, your deposit will be forfeited.  
6. Pre-Photo Shoot Meeting.  We will meet with you prior to your photo shoot either in person or have a phone consultation.  You can share images(s) of images that inspire you by emailing them to us at Elite@HartPhotography.Net.  We do not commit to replicate or imitate the image but simply like to see what style you are looking for. 
7. Location & Props. We will make recommendations for props, location and other suggestions.  Please look at our galleries and let us know if there is a specific style that you like.    
8. Photo Packages for less than 10 individuals. Your $375 service fee will cover the following:  
   1. Travel time up to 5 miles from 07627. $50 additional fee for upto 25 miles from 07627 for photo shoot.
   2. Services include a pre-photo shoot session consultation call or meeting.   
   3. Service includes: up to a one hour photo session. 
   4. Professional enhancement and editing of select images.  This is where Hart Photography excels!  
   5. Preparing your edited images for your Photo Reveal Session (PRS).  
   6. Travel to your home or agreed upon location to share your images on our screens.  
   7. All products are purchased Ala Carte.  A typical package is $1200.   
   8.  Preparation of for your Photo Reveal Session.  
   9. Occasional promotions may include a $100 photo print credit. Photo print credit can be applied toward the purchase of 5X7, 8.5X11 and 13×19 only. 
9. Hourly Rate. Our hourly rate is $350 per hour.  If your event is longer than 3 hours please ask for our Event Package information.  
10. Day of the Photo Shoot.  On the day of your photo shoot we will set up the staging area for your photo shoot and arrange any props as needed and at Hart Photography’s discretion.  We will instruct you on posing and use of props if previously agreed upon.  If you have a special pose you can feel free to tell us about it and it’s at Hart Photography’s discretion to accept the pose.  Hart Photography maintains a conservative style and may opt not to take images if the image is vulgar or sexually explicit or distasteful.  Hart Photography is under no obligation to photograph anyone or anything that has not been previously agreed upon. 
11. Photo Reveal Session PRS (Value $150).  The one hour Reveal Session is a service that Hart Photography offers and takes place approximately two – four weeks after your photo session or at an agreed upon date.  The Reveal Session includes the following:
    1. The One Hour Photo Reveal Session for a family photo shoot or for a kids photography or senior photography session which will include  include  1 – 50 images for your review.   
    2. Note that not all images are selected for the Reveal Session (example, someone may have blinked and that image will not be included). It is at Hart Photography’s discretion as to what images to include in the Reveal Session.  We want to show you as many images as possible so we are very selective of what images we exclude. 
    3. After you have had an opportunity to fall in love with your images we will ask you to let us know which are your must haves/favorites.  Any image that you don’t want may be permanently eliminated on the spot.   Hart Photography does not guarantee that your images will be saved after the Photo Reveal Session if not chosen as a must have.  Those images that you choose for a product will be saved to accomplish the product being ordered and may be deleted at any time. Hart Photography reserves the right to delete some or all images if we do not find a use for advertising or use for marketing material.

    5. Your images may be used in our social media or website(s) or other marketing material. 
    6. Adding Additional Time to Your Photo Reveal Session.  Your Photo Reveal Session  is up to an hour.  We understand that you may have a delayed family member that wants to join the Reveal Session.  Additional time during the initial/first Reveal  Session is $45. for 30 minute increments for up to a maximum of one additional hour if your Hart representative has the additional time slot available time.  For example, if you use two hours in total, the first hour is part of the One Hour Reveal Session or PRS and your second hour will be $90.  Your credit card will be charged this amount with no additional notice or it may be added to an outstanding invoice.   When does the PRS Start? Time starts once the first image is shown!  If the client is not available within 10 minutes of the scheduled time it will be at Hart Photography’s discretion to have to reschedule.  The second session will incur a re-scheduling fee of $100.  We recommend that everyone that is a decision maker be present at the Reveal Session or PRS. 
    7. Prior to your images going to print, we may send you an email confirming your order.  You will have to confirm via email PRINT MY PACKAGE.  If there is no response within 30 days, you will forfeit your package and no refund or credit’s will be issued. Images may be eliminated after 30 days and all monies forfeited.

    8. The Reveal Session will include the last photo shoot session only.  (For example, if you did a Spring Photo Shoot and later had a Thanksgiving Photo Session, then your Reveal Session will be for the last photo session and will not include any prior images.)  To schedule a PRS you must not have an outstanding balance.

    9. All orders must be placed during the Reveal Session.  All credits, if any, must be used during the initial reveal session and expire the day of the Reveal Session and can not be transferred.

    10. Placing Your Order.  You can select images that you want printed and products that you want to order at the Photo Reveal Session (PRS) .It will be the only time to view your images.  It is very important that all decision makers be present.  However, Hart Photography reserves the right to honor only the decision of the individual that originally hired Hart Photography.  All decisions for images must be made at the PRS.  No images used to display our work will be left behind with you after the Reveal Session unless you and Hart Photography have entered into an agreement to make a purchase.  

    11. No Cameras Please. We do not permit pictures to be taken of our images or recording(s) of our images to be taken during the photo shoot and/or during the  Reveal Session.  Hart Photography reserves the right to end a Reveal Session if we suspect that our images are being recorded or pictures are being taken of our images and no refund will be issued.   

    12. All payments must be received prior to the PRS.  All checks must have cleared prior to the PRS.  There is a $45 check return fee if your check does not clear.  A Reveal Session can not be scheduled until all payments are finalized at least 5 calendar days prior to PRS.  If a check has not cleared, we must reschedule your appointment.  All orders must be paid for prior to delivery of images/products. All Sales are final.

    13. If you need to reschedule a second PRS there will be an additional $125 charge. Keep in mind that not all images will be available since some may have been eliminated during the first PRS.   

    14. No refunds.  There are no refunds for services. There are no refunds for products. You agree to not request a refund for any reason.  Based on the nature of photography, once we release an image to you for purchase we can not “refund” you since that image has the potential of being duplicated.  Note that Hart Photography does not consent to any of it’s images to be duplicated without the written consent of Hart Photography.  

    15. Prior Photo Session.  At the PRS, only the most current photo shoot will be revealed.    (For example, if you did a Spring Photo Shoot and later booked a Thanksgiving Photo Session, then your Reveal Session will be for the Thanksgiving Photo Session and will not include any images from the Spring Photo Shoot.) 

    16. Image Storage/Archival . Hart Photography does not commit to store your images after the Reveal Session or PRS or 30 days after your photo shoot, which ever occurs later.  Hart Photography can store upto 100 images for $25 per 30 days.  Archive Retrieval Fee of $75. for images stored over 6 months.   If you have not made arrangements to participate in the Archive Program then please confirm that your images are indeed available prior to scheduling a Reveal Session.   

    17. Products are delivered once all payments have been made.  If client delays payment for whatever reason beyond 14 calendar days from the day of the photo shoot then client agrees to forfeit all products, images, money and agrees to retain no right of recourse.  

    18. Force Majeure. Hart Photography is excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party that materially affects the performance of Services, such as: an act of Nature (fires, explosions, earthquakes, hurricane, natural disasters, flooding, storms or infestation), or War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not), or any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

    19.  One Hour Photo Reveal Session.  Products are sold separately.  A promotion may allow at times for $100 credit toward image prints only. Image prints include 5X7, 8 1/2 X 11, and 13 X 19.  At the Reveal Session, you will be shown your images from the most recent photo shoot.  Not all images are selected (example, someone may have blinked and we will not include that image or any image that Hart Photography deems that it should not be part of the Reveal Session.  Keep in mind that we want to show you as many images as possible so we are very selective of what images we exclude.)  After you have seen your images we will ask you to start narrowing down to your “Favorites”.  You can then select images that you want printed and products that you want to order.  All decisions for images must be made at Reveal Session.  All credits must be used at the Reveal Session or forfeited. No images will be left behind with you after the Reveal Session unless you and Hart Photography have entered into an agreement to make a purchase.   We do not permit pictures to be taken of our images or recording(s) of our images to be taken during the Reveal Session or at any point.  We reserve the right to end a Reveal Session if we suspect that our images are being recorded or pictures are being taken of our images and no refund will be returned.  If your package includes a $100 print credit, the credit must be used at the Reveal Session Reveal or it will expire as soon as the Reveal session concludes.   All payments must be processed before a Reveal Session is scheduled.   All checks must clear at a minimum of 7 calendar days prior to a Reveal Session.  If a check has not cleared, we must reschedule your appointment.  $45 return fee check charge if your check does not clear.  The $45 must be paid along with any unpaid balances prior to the scheduling of a Reveal Session.

    20. Hart Photography is under no obligation to hold your images.  If you would like us to store your images please ask about the Archival Program.  Images not purchased at the Photo Reveal Session may be deleted instantly or at Hart Photography’s discretion.
